Defective equipment may lead to Louisiana workers’ compensation

On Behalf of | Oct 24, 2012 | Firm News, Workers' Compensation | 0 comments

When injured on the job, Louisiana workers have rights to medical care and compensation though a workers’ compensation claim. This can help alleviate the stress of being out of work and dealing with recovery while maintaining a family or a home. People injured by defective equipment at work will be covered by this and should be able to seek reimbursement for damages and injuries.

One man was injured and another was killed in an accident while working in Louisiana recently. A 44-year-old technician and his co-worker, a 25-year-old man, were working on an elevator when a cable snapped, sending the elevator plummeting toward the ground. The lift that the two were on fell to the ground which resulted in the death and injury.

The workers were at the Cargill industrial plant when the accident occurred. One man was pronounced dead at the scene, the other transported to LSU Public Hospital for treatment. Reports indicate that he sustained moderate injuries, not believed to be life-threatening. It is unclear how high the two fell from and if any other factors were involved in the accident.

Workers’ compensation in Louisiana protects people injured while in the normal routines of their employment. These two men were atop a lift, conducting some type of repair work or installation on an elevator when the accident occurred. An investigation will determine if they qualify for compensation benefits from a third-party due to some type of defective equipment. The injured party as well as the family of the deceased victim may seek experienced counsel to assess the results of the investigation and properly litigate a compensation claim.
