Driver charged with vehicular homicide in fatal accident

On Behalf of | Apr 8, 2015 | Firm News, Wrongful Death | 0 comments

Most Louisiana drivers are diligent about paying attention to the roadway and their surroundings. Sometimes, however, there is no way to predict what another driver on the road will do. In these cases, it may not be possible to avoid a serious or fatal accident.

Just before 7 a.m. on March 19, a 39-year-old woman was traveling east on Louisiana 631. Unexpectedly, a westbound vehicle veered into her path and crashed into her vehicle. The force of the collision propelled the woman’s car into a ditch, where it came to rest.

The woman succumbed to critical injuries at the scene. The westbound driver suffered unidentified injuries for which he was transported to LSU Interim Hospital. As a result of the investigation, the 37-year-old driver believed to be responsible for the accident was taken into custody on March 26 after officials obtained a warrant for his arrest. He faces charges of vehicular homicide, reckless operation and for failure to wear a seat belt. At last report, he was still incarcerated at the jail in St. Charles Parish.

In the meantime, the victim’s family is undoubtedly grieving over the tragic loss of their loved one. Her family may also be incurring a significant amount of debt and other damages associated with a fatal accident. They retain the right to file a wrongful death claim against the other driver in an attempt to obtain a monetary judgment against him. A successfully litigated claim could provide the family with financial restitution to defray the costs they have incurred.
